This page sets out the basis upon which I have agreed to provide my services and details the Terms of Engagement (correct as at: 01/01/2006).
Fees
- My fee for providing the services as agreed is determined by the scope of work to be undertaken and will be agreed at commencement.
- Property search and location services are charged at 1.00% of the agreed purchase price of the property, to be paid in full on completion. There is an initial charge of £1000 for this service which is refundable upon completion.
- The fees stated above do not include disbursements and expenses incurred on your behalf (e.g. transport costs for travel outside Central London). I would expect you to reimburse me for such expenses within 14 days of my request for payment.
- Where there are any changes to the services provided to you, the fee structure will be adjusted accordingly.
- Please note that I reserve the right to review and amend my fees each year (from January 1st) and you shall be notified in advance of any such changes.
- All fees are payable in advance. If you intend to pay by monthly Standing Order, I will provide a standing order form for you to complete. I shall deliver statements to you on an annual basis or more frequently if you so request.
Dealing with third party suppliers on your behalf
- I am able to engage the services and to deal with third party suppliers on your behalf. However, please note that you remain responsible for their fees, even where I have recommended and engaged them on your behalf. In some circumstances, I may request that you make available to me the required funds to meet their fees in full, in advance of said services or supplies.
- You may be assured that any information held on your files shall be treated as confidential and shall not be disclosed to any third parties without your prior consent.
- You agree to indemnify me (and any parties acting as my agents) from all claims, losses, expenses and fees (including legal fees) that may be incurred on your behalf and that may result from any actions directly or indirectly resulting from the assistance and/or advice that I have provided to you, including assistance and/or advice not provided.
- Please note that in recommending the services of any 3rd party service providers or suppliers, I do not accept any liability for their acts or omissions and any recommendations are made in good faith, without the intention of excluding your own right to make an independent choice. However, I will use my best endeavours to ensure that I source and recommend services and products that meet your expectations.
Holding Your Funds in my Client Account
- You may from time to time make funds available to me for facilitating the provision of my services to you. Such funds may be used for the purchase of goods or services for your use or for the use of those that you designate or as you shall instruct from time to time. Any such funds are held entirely to your order and for your benefit until I bill you in which case the fees due under my bill may be deducted from the funds that I am holding for you in my client account.
Termination of my Services
- The Services provided under this Agreement can be terminated with 3 month's notice by either party. (This does not apply to clients who purchase a bank of hours whose services will expire on the expiration of those hours).
